ยง 40-2.161 Municipal public health services plan; requirements

The plan shall contain a program designed to regulate public water systems, consistent with the provisions of Part 5 of the State Sanitary Code (10 NYCRR Part 5). The plan shall include, at a minimum, provisions for:

(a) a program for inspecting all community water systems at least annually and noncommunity systems triennially, but allowing community water systems with no recorded violations, served exclusively from groundwater sources, to be inspected biennially;

(b) a written inspection report to be sent to the water system within 90 days after the inspection;

(c) a microbiological surveillance sampling program that will have a minimum sampling frequency of one sample per year for community water systems serving 1,000 people or fewer, and four samples per year for community water systems serving greater than 1,000 people;

(d) logging and reviewing operation reports and water quality results within 10 days of receipt and notifying water suppliers of all violations that require public notification;

(e) requiring that plans and specifications for all water supply improvements be submitted in accordance with Part 5 of the State Sanitary Code and the State Education Law. The program shall provide for accepting or rejecting all plans within 45 days of receipt;

(f) taking appropriate action to bring all systems with violations into compliance with the State Sanitary Code;

(g) responding to each consumer complaint within 24 hours whenever a potential health hazard is indicated and within 72 hours in other situations and requiring timely correction of problems;

(h) maintaining a log of all complaints, including disposition;

(i) requiring a cross-connection control program for each community water system in compliance with section 5-1.31 of the State Sanitary Code and providing technical assistance in the development of these programs; and

(j) preparing and implementing a water supply emergency plan, exercising the plan once every two years and updating and amending it as required.
